    Principles can be expensive things but as has been said on many occasions defending a tribunal successfully can have long term benefits that may outweigh the costs incurred in the short term. If you defend successfully against an employee it can prevent other employees trying a fast one and taking you for more money.

    Up to a very, very limited point.

    In 99% of cases tribunal awards are small - less than £5K. If an ex-employee is of that mindset, backed by a Union or insurance they have nothing to lose by having ago. No two circumstances are identical. Mr or Miss Hard Done By will always think THEY have a case. The fact that XXX lost will have little bearing on it, particularly if they are not spending money trying.

    Also, an ET does not set a precedent (unlike an appeal). So the fact that one tribunal found in a certain way doesn't mean another will, even in very similar circumstances.

    I quite agree but if we goto Greendollars thread, the company have dragged this out for 2 years. I would have thought that would be off putting to other employees that even if they are right that they would probably think stuff it because would they want the stress for 2 years even for 5-10k?

    And this is where the company sound like they are going to lose...

    Hi ,

    2 years 2 months and still no date for a second Tribunal .
    My ex-employer even stated that intend to make my claim as diffcult as possible and ultimately try too take me for substancial costs (£15'000) ....' to serve as a lesson to any other employee even thinking of taking us to a Tribunal '. This statement was even quoted to the judge at a CMD and their solicitor didn't even deny it .
