3 years ago my dd ended up selling her house and settling all her debts. She moved in with us. She didnt do a redirection of her mail and early last year got a letter from a debt collection agency who had been writing to her old address and then ended up with her having a default on her credit file for just £100. She has contacted them to ask if this default can be removed or put back a coupld of years and they have said no. She has changed her life around and is now with a new partner and they need a mortgage but this silly default is stopping them. Is there any way round this.
Would they have to wait the full six years from the default.

Any suggestions would be welcome.

  • I may be wrong, but if she pays the £100 wont that settle the default??
    It's not a huge anmount and I would say contact the debt issuer, pay the amount and then get the default marked as settled or resolved..

    She settled the debt as soon as she found out about it last year. Default March, settled in april , she has been told by the debt collectors today after writing to them to see if it could be removed, that the default will stay on her file for six years even though it has been marked as settled.

    defaults do stay for 6 years

    but she can challenge the default on the basis she never received any notification of it

    Now thats something like what i needed.
    When she wrote to them she told them that she had not received any notification because of a change of address, but they have still said no.

    do you know of any template letters she can use.

    I have been talking to her more about it today and found out more.

    When she sold her house and rang around for settlement figures she paid all the settlement figures, but apparently one of the settlement figures she found out when she got thecollection letter was from a wrong settlement figure, apparently £25 short of what it should have been, this £25 turned into £100 with interest and charges, that she had no idea that this was owed, as far as she knew she paid them all and then moved out. and didnt hear anything else till the debt collection found her and of course she then paid it straightaway.
    Is that another lever she could use to challenge the default. I think it proably is but would like some sort of confirmation.

    She can get a mortgage even with the over 3 year old defaults, its this bloody ridiculously small one that is putting the spoke in it all

  • write to them stating that she paid the settlement figure that they quoted (include proof) then ask them to remove the default -- if they don't threaten them with going to FOS.

    There in lies the problem, 6 months after she paid everything off, assuming everything was clear, she shredded everything.

    How long do these people hold onto telephone records please.

    Depends on the company, they *should* keep everything for 6 years, but it's common for them to gt rid of phone records after 12 months due to the amount of space they take up, apparently.
