Just set up a dmp with cccs

My first post and I'd like to offer a big thank you to cccs for enabling me to put together a dmp which should get me sorted financially.

I (my wife and I) have debts totalling about £55k and an income of about £38k so hopefully repaying everything shouldn't be too painful an experience.

Got a few disappointing phone calls and letters from two creditors refusing the dmp and asking me to cough up more. Bank of Scotland just sent a letter. Nationwide sent a letter yesterday and followed up with a phone call today, obviously having a lot of faith in Royal Mail! I told them they would need to talk to cccs as I won't do anything without their advice. I did ask how much they would accept and they said about £200 a month compared to the £70 I was offering and could afford. They did say that they may reconsider if I reduced my living expenses on my soa but weren't forthcoming about quite how I would make up this shortfall considering how the other 8 creditors would follow suit!

In the end they said they would continue with the interest and would pass it back to their collections account, and I would be subjected to phone calls etc, and after 90 days they would pass it to 'Excel'? and they may try to link the debt to my mortgage ( which is also with Nationwide and up to date ). I said if they're going to start phoning me then they can remove all numbers for me from their systems which they did, and I want all communications in writing.

I've been with the Nationwide since about 1979 and always found them helpful but I suppose once you owe then the mask always slips.

So I suppose I'm now a the stage where it's going to be a battle with the creditors to get all 9 of them to agree to the DMP. Should be fun :( Rather takes the edge of the delight of logging into my new bank account and seeing money left over at the end of the month!

    DON'T talk to them on the phone, CCCS will do your negotiating for you and will set the repayments levels based on your SOA. Very often they never "accept" the DMP but take the money anyway, so don't worry too much about acceptance. They always want more, they don't seem to be able to help themselves and CCCS will not allow one creditor to be advantaged over the others. There are a couple of letters on here you can send to ask that they stop phoning, the best way to deal is to change your phone number. The banks unfortunately have no ethics, if you are borrowing and paying it back, they think "cashcow", if you can't pay it back, they think "give me the money now, starve your children, live on the street, we don't care but give us the money!". The fact that you've been banking with them for around 30 years means nothing to them, you are just another debtor now. They CANNOT link unsecured debt to your mortgage, this is just piffle, ask them to write all this down and I think you'll find them a bit more circumspect, they would have to go through the courts, get CCJ and a charging order to even begin to do this. Sorry to seem harsh but the fact is your previous loyalty means nothing to them and they will say anything (a lot of it untrue) to get you to pay more. You have to be strong and assertive, you are in a DMP, you are doing your best and if you haven't got it, they can't have it. and by the way, its debt, not a capital crime!

  • I wouldn't worry too much about the mortgage either. I have debts with Abbey (or Santander as it is now) and my mortgage is with Abbey and that has not been affected at all even though I found out last month that I am in credit by a few hundred quid on mortgage account (yay) not sure how that has happened but that credit is not being taken to service my Abbey debts. They are totally separate.

    Creditors will come out with all sorts and are mainly full of hot air. They just bluster and throw their toys around a bit, but most is just tosh.

  • Sorry, just read your post further.

    I'm assuming that Excel are a debt collection agency (DCA)? If so, I wouldn't worry if that happens - DCA's tend to accept lower payments and freeze interest, so it's not that scary!

    Its a pity you don't have a recording of the conversation with the Nationwid, you could then complain to the banking ombudsman, OFT the lot. To say that they could link your unsecured debt to your mortgage is a downright lie. They could get a charging order, but that would be after getting a CCJ and thats a long way down the line.

    Lying muppets.

    Just keep paying CCCS, things will calm down.
