I can sympathise with you having finished a 5 year plan (or rather joke) with DCM Apex in June this year.
I am currently working with the Royal British Legion and CAB to see what routes I may (or may not have) for legal action. They have passed on the agreement (and various other bits of paperwork I have collected together) to a solicitor to review and advice where I stand.
Problems I have had with them:
- CCJ issued Dec 2008.
- Same company took further legal action (applied for an agreed notice) in June this year.
- They have consistenly failed to make regular payments to creditors, with anything up to 6 months between payments.
- Up until about a year ago they made all their payments by cheque, which meant when they did pay they were always late.
- Their communication is diabolical, nobody knows whats going on with your account, the person dealing with my account didnt even work for DCM any longer (as I found out) and was only in the office 1 hour per day to clear existing work!
- My fees haven't been refunded (3 months after agreement ended) which it states clearly will happen if they don't clear ALL the debts.
- I have been preliminarly told that their agreement reads like an 'illegal IVA' because it has no court judgement to back it up.
I suspect I wont get anywhere along the legal action route, but I am certainly going to give it a go. I have already contacted all the otustanding creditors and sorted out payments with them myself, it took me about 2 hours to do that ...... after a 5 year headache!0
