Advice Please, DMP Split Up

Basically split from wife last year we have two young kids, we had a dmp, mortgage and secured loan. She proposed that i move out, she pay the secured loan and mortgage and i pay the DMP.
I have been renting a house with my brother since NOV. I have struggled but could cope, just. She has now hit the panic button saying she cant cope anymore.
I have now told CCCS the situation about the split and they have done my SOA and are ringing me on tuesday with advice. But i cant wait till then worrying so i just wondered if any of the knowledgeable people out there could say what they think will happen:
My current monthly SOA: (bills are half as shave with brother)
Income take home: £1281
Council tax: £58
water: £15:50
Elec+gas: £18:50 (summer) £36 (winter)
Child saving: £15
Union: £9.63
Sky(phone,tv, net): £24.50
Tv licence: £6
Rent: £287:50
Life Assurance: £12:20
Motorbike ins: £8.34
Mobile: £25
Child maintenance: £200
Petrol: £30-50pm
Food: £200 (estimate as single man doesnt really shop for food)

I also pay the DMP :£256
She Pays the Mortgage: £411
and the Secured loan: £444.27

The half the DMP in my name is :£19693
The share in her name is :£11658

The mortgage has a settlement of:£73,779.58
The secured loan settlement is: £37,328
The house was recently valued at :£105-110k

She's going to pay the mortgage and secured loan and keep the house? And the two are the value of the house?

Thats about the sum of it. But surely the cccs will split the mortgage and the secured loan and then as most of the dmp debts were credit cards in my name to pay for crap we didn;t need but she wanted surely my options are limited to looking at bankcruptcy meaning the house will be sold...?

I would have thought that the DMP will need to be re-assessed to find out what you can actually pay towards it.
However, CCCS may suggest that you un-bundle the DMP and each pay for your own debts.
The more important issue is your wife and her not coping with the mortgage and the secured loan. Assuming she has not taken it on herself and it is still joint debt, you have shared responsibility for it. You need advice, but I have no idea where you get it...
I don't think CCCS will have anything to do with the secured debt - it can't go into a DMP.
Also, if you go bankrupt and the house is in joint names, your OH becomes liable for all of the debt.

I think you need legal advice and to figure out what you will do long term - as has been said if she doesn't keep up the mortageg/secured loan it will affect your credit and they can come after you as well. She may have to buy you out of the house or perhaps the house will be sold - either way I think you need to get some legal advice.

The dmp is being re done seperately, i'm hoping though that they do advise me for the whole situation otherwise its pointless. I'll try and get some legal advice on monday.
See i dont know if the secured loan (ars*h**es) can stop the house being sold. Some people have said no and that any shortfall then just becomes unsecured debt..!Its time to nut up or shut up......!:laugh:
