Hi, new here so hello guys/gals. great site/forums!
my wife is due to drop end of jan and i'm gettig more an more concerned about the paternity pay and other benefits that we are supposed to get. i've read all the official sites and documents but it dont really give much info on the things i want to know.
1) i've got a company car and as such am paying about 200quid a month extra tax becuase of this (fuel included) if i was to take the 2 weeks paternity and assuming my boss isnt going to pay more than statatury, will i be charged tax etc on the £108 per week? if so then i'm pretty much not going to get anything
do you get taxed at all on the 108quid?
2) my boss usually hassles me when i am off on hols as i am pretty much the only support the customers of my company have, and as such if things go wrong i have to sort it.. even if i'm on hols etc
with that in mind i can pretty much guess that boss will ask me to do support during my time off. can he do this? can i legally tell him he is being unreasonable? (i mentioned to him the other day on the phone that i need to give him the dates etc to make it all official about me wanting to take leave for paternity and he just said "we dont do paternity" he made his excuses and hung up.)
3) not really paternity related, but the child tax credits etc. from what it looks of things when you fill out the forms we will have to put that wife earned x amount last year and therefor we wont get any tax credits but if she is not going back to work, do we have to wait until the following year before we can claim and get that? (its 500quid)
thanks for any input on this.

Hi thefunkygibbon and welcome!
I can't answer all your questions but there is information about paternity rights on the BBC website and the TUC website has a downloadable leaflet with more details.Torgwen..........

Reference Question 3:
I think you can use projected income figures.
My wife is currently on extended maternity leave, i.e. unpaid. Her paid leave ended back in April.
We applied for Tax Credits around April/May and used our income for the tax year 2005/2006. We got credits based on those figures. However, my wife has had no income since April and only intends to go back to work part time, probably not until the New year. So we called the tax credits people to ask about it.
They basically worked it out pro-rata, i.e. estimated part time income from January to April 2007. (The only time when she'll be earning.)
We're still waiting to hear from them to see how it effects our tax credits.0 -
thanks for those two replies. i've already checked out those two sites but couldnt really get an answer specific to my circumstances.

SPP and SMP is taxable income, but you can ignore £100 per week of income for Tax Credit purposes for every week that SMP or SPP is claimed (if you both receive them in the same week you can ignore £100 each)

The company car will be taxed as usual.
with ref to your 3rd question, you need to estimate your income for the year and supply that figure, they'll then adjust this yrs award on the basis on that declared income and then you when you finalise at the yr end, they'll recalculate and make any adjustments.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
1) if you get the £108 statutory you will be taxed at your usual rate but this is usually about £20 % so is worth having.
2) you should tell your boss to FO
3) Tax credits are initially bassed on last years earnings but as soon as they write to you to tell you that you are not entitled you can call them to give them your new income (change of circumstances)
