Question:
NRP is still paying for a mortgage for a house they no longer have. Long story however, when NRP and his ex were together they put the house up for sale, couldnt sell it, so handed the keys in to the mortgage co. They auctioned the house and got 10 grand less than they owed on the mortgage. They split up a couple of years later, NRP is still paying this shortfall off. Can he apply for a variation to the CSA. Not that he really wants to as if it doesnt get paid, they take him to court not his ex. p.s mortgae was in both names and it was the family home.

CSA 2. I dont think he can, Im just being a !!!!! for a change. Sick of dancing to PWC tune. (Im NRPP). Just had a load of untrue and hurtful abuse off her. 10 years, married again with another 2 kids, and still bitter0

for a variation to succeed the PWC would need to still have the benefit of the debt the NRP is paying ie still in the house or if say car payment pwc still need to have the car.

In short, no. The NRP was a named person on that mortgage, so had a beneficial interest in it anyway. Plus the PWC had to still have the benefit of it now.0

Nope, sorry - if the PWC still lived there it would be different (done under prior debts if NRP name still on mortgage) but as this isn't the case it's like all other debts, not taken into consideration under CS2.0
