In DMP should I still ask for CCA's and SAR's?

Hi Guys

Looks a great forum.

We got into a mess years ago and ended up getting bombarded by debt collection agencies via phone, letters, cards posted through all to a point where I felt I could no longer go on.

I tried talking to them but they were such !!!!!! that I gradually thought f**k them all, they can't kill me and so i got a debt management company on the case who seemed to help quite a bit.

We both work, we have a baby due any day now and we have a mortgage which is probably more than the house is worth and no other assets, all the debts are unsecured and we have made a dent in them over the last couple of years but there will be many more years to go and when they send the odd threatening letter it makes you wonder why you bother to pay them on time every month.

Anyway, my question is, even though we are in a debt management plan we have never asked any of these creditors for SAR's or CCA's as at the time it just seemed so easy to get the Debt management company to sort it all out, I now know much better and know I shoul have asked for all this in the first place.Can I still ask all the collection agencies for CCA's and SAR's even though we have been paying amounts to them for a few years?.

Also any help with letters would be great :j

Any help much appreciated and I hope to eventually be able to help others out who were in the same boat as me with no knowledge of what to do. Its so sad to read of people here in the UK killing themselves over situations like what we found ourselves in, when you think if only they had known the right place to turn to for help it could have saved their life.

    Hi Mac,

    Well done for finding the site, it is very helpful I know! Firstly, I hope that you're not paying a debt management company to administer your DMP, as you may know there are charities that will do it for free. Try googling "CCCS", "Payplan" or "Christians against Poverty", all of which will be able to help you.

    There are lots of template letters for requesting CCA's and SAR's along with a wealth of other info for those in debt. Have you managed to get your interest and charges stopped on the accounts? If not, there are template letters on the National Debtline website here...

    thats a good question op i am worried that if i go the cca route the dca's might starting harder to get the debt repaid ie ccj's ect

    There is a useful FAQ section in the previous enforceability thread that gives more information as to when you should go down this route.

    I think that requesting a CCA will not cause too many problems, it is stopping paying that causes the problem and will trash your credit rating. I you already have defaults, then you may decide to proceed.

    There are flow charts to follow in https://forums.moneysavingexpert.com/discussion/2305463. While you are waiting for a valid CCA, you cannot be taken to court (the account is in dispute)

    You also need to be aware that the letters are not being updated any more, as the thread creator has left MSE.
