Stautory redundancy from the government

Do the government pay statutory redundancy?

The reason I ask is that from march 2001 until april 2006 I worked for a market research company every month doing mystery shopping. In January of this year, the announced they would no longer be doing mysery shopping, this in effect making me redundant.

I wrote to them claiming redundancy but my claim was denied. Since then, I applied for and was accepted for a position in their London office, so as you can imagine I dont want to take further action with the company as it could make my new job difficult.

  • Someone who knows more about employment law than I do will probably be along to correct me, but...

    This kind of work is usually on a casual basis no commitment on either side. I'm not sure whether this would count as 'employment' or not. This link suggests that it could be.

    Would the amount you'd potentially get make a fight worthwhile?

    As far as I'm aware the Government only pay statutory redundacy when the employer has gone bust and is unable to do so.

    Assuming that the company is solvent then any redundancy entitlement should be paid by the company. I assume that this is the case as you are now working for them again.

    The only time that the government will intervene in the case of a solvent company is where a Tribunal have awarded you a redundancy payment and the company still refuse to pay.

    Why did the company refuse your claim for redundancy?
    Gone ... or have I?

    They refused to make you redundant so you took another job within the same firm. Why would you expect redundancy pay from the Govt - you seem to have accepted alternative suitable employment so you haven't any grounds for redundancy. That is, unless the job you have taken has proved to be an unsuitable alternative.

    I was made redundant in April and I was informed this would be the end of my employment. The company's main body then advertised jobs in august which I applied for via an agency, which I was successfully interviewed for.
