Hi there
Does anyone know the criteria you need to meet inorder to qualify for an advance payment on arrears owed?
Tried asking CSA today and went round in circles without getting an answer - surprise surprise.

I have no idea, but I am very doubtful that such a scheme exists, if it did can you imagine how many PWC's could be getting money rather than waiting years.*SIGH*

I believe it is possible but very difficult, to get an advance payment from the CSA if arrears have built up due to their errors and maladministration.
I am currently in the process of applying for an advance payment. I have written to the CSA but my letter has been ignored so I am now going to refer it to ICE to see if that will get a response from the CSA.
However, I have been told by my case worker that when I have received 3 payments via the current DEO I can apply for an advance payment. Apparently, the CSA need to know that there is a good chance that you would have been paid had it not been for their mistakes and also that they stand a good chance of recovering the arrears from the NRP. The 3 payments are taken to be proof of that. Also, the arrears should be of an amount that the NRP would not be able to clear within 2 years on the current payment schedule.

Yes if they have made a mess of your case, im going through the same they put me on CS2 when I should have been on CS1 and they have admitted their mistake and I still havent had any money yet even though they have all the NRP income details etc its been a year now and my arrears have gone into thousands now on top of the thousands already owed the NRP pays £40 a month off the arrears so im not gonna get the all the arrears in the 2 years at that rate.0

Sarahx1 - you can apply for an advanced payment of maintenance.
Basic criteria is, there must be maladministration on your case - as in not acting on a change of circumstance, not doing reviews when they were due, unnacceptable delay (outwith their timescales), etc etc.
There also needs to be interest shown from the PWC - don't expect a payment if you have left it years and not bothered contacting them - unless of course the CSA lead you to believe nothing could be done for that period.
NRP needs to demonstrate regular payments - guidance states 6, although they can accept less and they can also accept payments made previously to them becoming involved, such as court order payments if this was regular prior to them becoming involved and the payments stopping.
They won't pay advanced maintenance if the NRP just hasn't bothered paying or avoided contact, unless of course it is found (as in my case) they hadn't pursued the NRP or dealt with the case as they should have.
They will only pay for periods where maladministration applies, so you may have arrears that were not down to CSA error that wouldn't be included.
It can be done, I got most of my arrears from Ex no. 1 back in an advanced payment last year, after complaining and then progressing it to ICE. I have also had a request for an advance payment for Ex no 2. refused as my ex hadn't demonstrated 6 months payments even though I argued they can take a lesser amount in and quoted guidance at them...think that may have !!!!!! them off a bit lol.
Keep at it, I would try and progress it through ICE if I were you.

Does making a mess of your case include not receiving back pay or any money for 13 years??
At my wits end with the CSA I have done so much tracking down etc and still promises of money but nothing ever materialises!!:mad:0 -

They know where he is working now....unless he has moved on again, as for wage slip details I wouldn't know we don't have any contact at all and the CSA won't give me such information
Apparently he owes my daughter £104.63 per week of which £26 per week is arrears.
I have been receiving letters like this since 2003 she was born in 1997 which was when the original claim was made.
I cannot believe how poor the system is

Your best bet is to go on the CSA website and make a complaint by e-mail if that doesnt get the ball rolling go to ICE (iNDEPENDANT CASE EXAMINER)0
