Nationwide Collectors

Please Help!!

Received a letter from Nationwide today saying that they were going to send debt collectors to my house to collect the arrears and discuss the situation I am in.
I've been on a DMP for over 2 years now and thought that things had settled, but then i receive this.

Has anyone experience of a letter like this before and if so do they have any advice on what I should do? I've contacted Payplan, who are my DMP people, but feel very unnerved!

They cannot turn up without making an appointment with you and you are within your rights to not make one with them.
In the unlikely event anyone does turn up, tell them to go fox trot oscar & call the police if they refuse...
  • Hi

Send them the letter below, recorded delivery and only sign it digitally,

    SnV

    Dear Sir or Madam,

    Account Ref xxxx

Please be advised that I will only communicate with you in writing.

Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).

Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

  • Thanks so much for the information and the letter. I've done exactly what you suggested and will send it in the morning. I'm really glad I asked. Thanks

Wait for them to turn up (extremely unlikey, it costs £££££s to send people out) and then point and laugh at them through the window.

They have less rights to do this than a dead cat.

Or talk to them throught the letterbox in the style of Mr Kenneth Williams....ohhhhh matron etc etc

  • I'd love to do that, really wind them up. The thing is when I get a letter like that it really winds me up. I should learn to chill out and not panic.
In 2 years i've paid back £16,000 to my creditors so feel like i'm doing ok. £19,000 still to go so when I get a letter like that it makes me feel pretty useless.

And thats exactly the intention so don't let them get at you.

You've paid back nearly half your debt in 2 years which is brilliant work :T

Don't let some gonad juggling cheese monkeys distract you from that point!

It sounds like there is a problem with your DMP, you should contact the Nationwide to discuss it with them or ask your Debt Management Company to call them.

They wouldn't just suddenly decide to send someone round for no reason, there must be some problem. Call them to find out. Sending the letter above isn't going to get the problem sorted and your DMP back on track.

Mike its likely there will be no problem at all with the OP's DMP. Companies are under no obligation to accept a DMP and can continue debt recovery procedures regardless (and many do).

The OP !s worried a doorstep collector will call and under OFT guidelines they are only allowed to do this by making an appointment so the letter is sound and will have no bearing on the state of the OP's DMP especially its likely that there is nothing wrong in the first place.

As for the 'they wouldn't send a doorstep collector round for no reason' comment this is a common threat used by creditors to frighten debtors and co-erce them into paying more than they can afford, another reason to stand your ground and let them know you are aware of your consumer rights.

You are also asking the OP to break one of the main rules of dealing with creditors by asking the OP to telephone them. You should NEVER do this as many things get said by creditors on the phone that they would never commit to in writing.

I do agree that the OP could call their DMP company to ensure that payments are still being made. If they are then that just reinforces what I have said above.
