Creditor & DCA Reclaim Query

Hello.

I am starting my first claim against one of my creditors to reclaim all the illegal and unfair charges actioned against my account. I have chosen quite a small fish in the scheme of things as I do not owe them much money. It also gives me a practice run so I am ready to take on the bigger fish :)

The target company is Orange who I had a mobile phone contract with around 12 months ago. The debt is now managed or perhaps maybe even owned by a Debt Collection Agency - Moorcroft.

I am currently on a self managed DMP and I have been repaying this balance slowly but surely.

I have already prepared a DPA/SAR and will be sending it by recorded delivery this next week to Orange. However, if the DCA now own the debt and they have been applying charges themselves (which I believe they have) do I also need to do a DPA/SAR request to them too?

I believe Orange charged a disproportionately high disconnection fee and I also believe Moorcroft have been applying charges since taking over the debt.

It just seems a bit costly to have to claim twice for the same debt.

I appreciate any information and no doubt I will have a few more questions along the way.

I know there is a reclaiming bank charges thread in another forum, but this isn't bank charges so I have posted it here for now, unless a mod deems it to be more suitable elsewhere :D

    Whilst you are not reclaiming twice for the same debt, that doesn't really come into it. If Orange have applied charges then try and claim likewise for moorcroft.

    It is worth pointing out that it is quite costly to provide you with a connection as there is quite a lot of equipment "their end" including providing a second individual number for your message service. The cost of this is often more than your connection charge (especially if this was free) and they hope to recoup this during the course of your contract. This is why it costs so much to buy out of a contract.

    Perhaps I should go down the DPA root with Moorcroft then as they seem to have added alsorts of fees onto the balance!
