Coucil Tax HELP

Hi all,

my house was repossesed on the 21/06/2010.

I told my local authority when I moved out in March what was happening and why I was moving out. They told me that the council tax had to be paid by myself as I was still the owner of the property. Although they gave it me for half price as it was classed as a seccond home.

My home has since been repossesed.

Today 28/08/2010 I have recieved a council tax demand for my old property which no longer belongs to me as it was repossesed in June.

Does anyone know if I am liable for this council tax or do I give them my mortgage providers address to pass on to the new owners?

    It should have been exempt for 6 months as it was empty. Reason "Q" I think as on the forms. Had you paid CTax up till you moved out? Have you gone bankrupt yet?

    You are still liable for the debts until the place is sold - not repossessed, but the debt will eventually go into the BR pot (if BR) once it has sold. Until then, they can chase you for it. So you need to reduce your liability as much as possible and half price is not the same as a 6 month exemption.
  • I gave you wrong information, it wasn't half price it was 6 month exemption. I did continue to pay council tax up until I moved out of the property.

    I haven't gone bankrupt as of yet, I don't really know if it is the right avenue to go down, I have very little other debt probably on £5k because my outgoings are alot less since I moved out I have been able to pay off alot and a family member has lent me some money to consolidate some of the debts.

    I'm not sure how much the house will sell for, I did alot of improvements to it since I brought it so it should be near to what I owe on it, I would think at most £20k shortfall.

    Is it really worth going bankrupt for that amount?

    BR is a last resort solution. (As its the BR board, I assumed you were or thinking about it!)

    If you are unable to pay your creditors then BR is a possibility (regardless of what you owe). But as to the council tax, you are liable for it until the property is sold on. Have a chat with the likes of SHELTER and they may be able to help get the council to write it off.
