Lived in the UK for less than 6 months in previous tax year...

Hello,
I lived and worked in the UK for 5 months and 17 days, between 25.08.09 and 11.02.10 (I worked between 26.08.09 and 05.02.10), then moved to Germany. I was living in Italy before coming to the UK.
I sent a P85 form to HMRC, and after a few weeks received a refund of 107 pounds on the few hundreds of pounds I paid as income tax.
Since I lived less than 183 days in the UK, should I have instead received a full refund of income tax?
Also, is there any way to have back my National Insurance contributions, or have them transferred to a private fund, where I could manage them on my own? I doubt that at 68-70-whatever I will get anything from HMRC...

  • NI conts are never repayable.
    As an EU national, you are entitled to the saem tax free allowances as everyone else in the UK and this is what would have been repaid to you. There is no general exemption from tax for you.

    Did you file as a non-resident? Did you claim the remittance basis? Do you qualify for detached duty relief?

    Sorry, but I barely understand what you wrote...What is the "remittance basis"? And "detached duty relief"?

    It sounds as though you have not completed your tax return corectly so claimed too large a refund. You need to file reporting yourself as a non-UK resident.

    Whether or not he/she was non-resident is not the issue. I am assuming the person was working in the UK so the remittance basis is not relevant.

    Non resident does not mean the earnings arising in the UK are exempt from tax. As has already been pointed out, as an EU citizen you are entitled to UK personal allowances, that is all. The fact this person worked until Feb 10 means they have utilised the majority of their personal allowance and the repayment will be correct on the portion of unused allowance.
