On maternity leave now,and pregnant again..

Hi,

I hope someone can help - im getting no joy understanding the info on the .gov sites.

My partner is currently on maternity leave, due to go back at the start of Oct after 12 months off.We are however expecting our 2nd child at the start of Feb.

If she doesnt go back to work would we be entiteled to maternity allowance?

Thanks for any help.

    Yeah congratulations, on the new baby - and on the baby to be!

    Your best thing to do would maybe to speak to someone at the Citizens Advice Bureau - or have you tried ringing the Benefits Enquiry Line on 0800 882200

    Her best option would be to try and return part time if she can and then she would stil be entitled to full materity pay (SMP) plus holiday pay etc. She can go on maternity leave when she is 29 weeks, so it would only be for a period of six weeks or so?

    Looking at the dates, I think that she could still qualify for maternity allowance too though:
    To get MA you must have:
    • been employed and/or self-employed for at least 26 week in the 66 weeks up to and including the week before your baby is due. This 66 week period is known as the test period. Part weeks are counted as full weeks; and
    • earned on average at least £30 or more a week, in any 13 weeks in the test period.
    Being on maternity leave qualifies as "working" afaik.
