CCA not available!....next step?......help please

hi,
the last line of their letter says they want a reply within 7 days. I am still unsure what my reply should be to them. I have asked HSBC the details of my bank account charges so i can identify what debt is bank account and what is loan. The loan takes up at least 95% of the total 8K. Start getting nervous when i get pushed by these people. Please can someone give me a directive on what i should reply with. Thanks.0 -

LL - Only you can decide what to do. If I was you I would not be concerned about the sentence regarding further enforcement ... after all what can they do? you already have a default on this account and they can't take you to court???
I think you have 3 options
1. You ignore the letter and do nothing (the DCA has said it is not enforceable).
2. You reply telling them it is not enforceable and it is against OFT rules for them to continue to seek payment. If you want to do this, you need to send a slightly edited version of the letter from this link http://forums.moneysavingexpert.com/showpost.html?p=33792037&postcount=20. Basically take out the parts about the CCA but leave in that it is enforceable and about OFT rules.
3. You offer them a very reduced F&F settlement so that they go away. By very reduced I mean start at 10%. The only advantage of this one is that the default will show as partially settled, but I am not sure whether that makes much difference to your credit file as it is a default.
My preference would be number 2. It is your final response, you do not need to do any more.0
