    it is the first time in 2 years i have taken off a long period of time. My husband lost his job the day after the doctor signed me off work, it was unexpected as he worked for his Dad .

    So you hadn't taken any holiday in the first year?
    The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!

    Why is this time differant to other times you have had of on holiday or sick, presumably you had to catch up then?

    Regarding the sick pay, have you got any proof that it was work related? If not then you have very little chance of getting paid, if you do you maybe able to get something but you may need to goto an Employment tribunal and if you do this your card is marked.

    If you knew your hubby was losing his job then I would have thought this has an effect on your stress levels surely and thus the blame cannot be 100% directed at work?

    Even if you have proof that the stress is work related and solely work related, and then proof that the employer has acted negligently in allowing a stressful situation in the workplace to get out of hand (both nigh on impossible tasks) - you couldn't take it to a tribunal anyway because they have no jurisdiction. You would have to take a claim of personal injury which is a higher proof of evidence than a tribunal. It's been done - but not often. That said, I am afraid it's sick pay if you are sick - whetever the cause. There is no legal right to be paid anything else, even if the employer caused the illness - which you simply won't prove. Sorry, but you either need to deal with the situation at work, learn to ignore it and just do your job, or find a new job. Those are the only viable options.

    no more than 4 days at a time, also only been under that manager for the past 11 months
