any advice as what to do0

I would suggest that you follow the process outlined in the unenforceability thread III and letters from IV
Because you have not paid, they have put a default on your account and passed it on to a debt collection agency.
I would suggest you send a CCA query letter telling them that you have received an application from and you want the agreement.

I'm also gonna say send the CCA query letter...
http://forums.moneysavingexpert.com/showpost.html?p=33791719&postcount=14I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

Why on earth did you start the CCA route when you clealry dont have the first clue what your doing ?
I suggest taking the time to udnerstand it PROPERLY by following the advice already given0 -
Fear not with Halifax...ive been through the mill with these clowns & their default notices/threats are not worth the paper they are printed on.
They may pass you onto Buchanan Clark & Wells, then Albion collections & then Fairfax Solicitors - each as useless/powerless as each other
Remember the phrase - no CCA = no enforcable debt = no payments = end of.
Report them to OFT,trading standards and the financial ombudsman service, if you fancy causing a bit of aggro for them

Did you send the CCA query letter and did Halifax respond?
You can send an account sold in dispute letter telling the DCA that you are waiting for a CCA http://forums.moneysavingexpert.com/showpost.html?p=33791899&postcount=140 -
have been waiting for over 10 months they sent an application form then pages saying condition of use then typed papers with heading credit card agreement not signed and not from when i opened account as it has my marriage name and no i dont really know what i,m doing0

They know they havent got a CCA & are trying to fob you off with any old printed out garbage.....the cheeky sods then pass you on to the DCA industry.
