CapQuest...

Hi.

I searched google for Capquest and complaint and I got some info from this site that was very helpful.

CapQuest was harrasing me for a debt. They were phoning me up and saying I couldnt make a payment plan, that I was going to be sued, I was going to prison, and that I had to pay the full amount immediately, with interest of £19 a month added on.

I sent them a £1 postal order and asking for a signed copy of the original loan agreement.

I then received what was obviously a fake letter back from Bank Of Scotland, telling me the loan amount in December 2005 was the exact up-to-date figure that capquest are demanding from me (the figure with their £19 a month interest added on). I know it was fake, because the original loan was from the Royal Bank of Scotland. This is a completely seperate company. It seems someone at Capquest got very sloppy.

I phoned them back and demanded to know what was going on... And I got the usual rude and obnoxious people on the other end. Anyway I advised them not to bother me again unless they are prepared to supply the documents I asked for otherwise I will report them to the Police for harrasment.

The next day after receiving the fake bank letter I received no less than THREE letters from capquest.

Letter 1

You have to supply further information before we can process your request. We need ID and your previous address's for the last three years. This letter correctly identified the loan was with the Royal Bank of Scotland. You have 10 days to reply otherwise we will pass this to our debt collectors

Letter 2

You account is on hold for 28 days whilst we look into this matter.

Letter 3

You account is on hold for 14 days, you must make payments immediately, this debt will not go away. Non response will result in court action.

I am thankful for this website. I have learned from it that I am entitled to the original and signed loan agreement under the Consumer Credit Act. And that if the company doesnt supply it they are acting illegally.

I am thankful that I know that I do not have to provide any ID to this company to obtain this document.

I am thankful that I know they cannot add interest other than what was agreed in the original loan agreement.

I have had all the above confirmed with the Office of Fair Trading, who are now handling this company on my behalf.

I am thankful that I did not buckle under their horrid lies and blasted aggression. How is this company allowed to continue to trade??

    Go straight to Trading Standards. Do not pass Go. Do not pause to collect your hat.

    I just can't believe people can do that and remain out of prison.

  • I have just done that ZTD.

    Honestly I have never seen anything like it. It was on headed paper, but you could tell it was a fill in the blanks template. It was obvious that someone in capquest had seen bank of scotland, and by the time they had found the template they had forgot it was the Royal Bank of Scotland. or perhaps they thought it was the same company anyway...

    It might also be worth sending it to the BoS as well. Let them know that the OFT are dealing with it, but I am sure that they will wish to "protect their brand" once that's finished.

    I'll be frank. I can't believe it. I'm almost speechless, and that's quite hard. :rotfl:

    I mean obtaining money by deception. Presenting a false instrument. These are criminal offences. I can't believe it...

    You're probably right. The BoS and RBoS can be confused if you're not careful.

    I would actually go to the police. If they did this to you, how many other people have been subjected to the same treatment?

  • Would the police do anything? I know its a criminal offence, but I thought that I had to take them to court or something.

    If, as it most certainly would appear to be, is a criminal offence, then it is your legal duty to report it to the police, or you too could be breaking the law by not reporting it. What they then do about it is up to them, but they must record your complaint and will probably give you a crime number which you may need if ever the matter does come to court.
    This, however, should not stop you from also reporting it to Trading Standards, OFT and the Credit Services Association. In fact, the more people you report it to the better.
