Hello all,
Those of you who know of us, will remember we have won Tribunal hearing, and trying desperately to get several MA's corrected, and also the alleged arrears!! In an attempt to have the 34k debt, LO, CCJ , and interim charge on our home removed.
CSA have written to us with a new re-vamped MA for several of those the Tribunal Judge told them to correct, they all seem correct apart from one, whereby CSA have included child tax credits into NRP assessable income as 'other income'.
Can anyone lead me to the specific quotes/sections of CSA which stipulates that Child Tax Credits are not to be used for assessable income purposes. I am aware of the situation regarding WTC etc, but this irrelevant as we have never ever received WTC.
Any help much appreciated - oh and just an update, yes we have in writiing now that the maintenance we have been paying is over the assessed amounts, so the arrears I suspect will be £0, in fact we think we will have overpaid PWC via CSA. Surprised - NOT!!! :mad:
But, the children will have benefitted from the money so our conscience are clear, and we do not intend to ask for any monies back from PWC! Even though we have had severeal poison pen letters demanding we pay her the 34k NOW, that CSA told her we owed - wounder!!!

CTC is classed as income, but usually only if the NRP makes the agency aware of it. With WTC it depends who is the higher earner but CTC is always income - you get the reduction for the ROCs though to balance this out slightly. How did they become aware of your CTC if you don't mind me asking?0

Missbunbury - they became aware of CTC as Tribunal Judge asked for evidence of absolutely everything, not a problem we have nothing to hide.
As far as I believe, CTC is used in CS1 assessment but only in the protected element of the calculation if the NRP is not the main wage earner (as in our case), I earn more than my hubs (who is NRP), he works part-time and is also the main childcare provider in our household. It makes sense for me to go out to work more, as I have a higher earning capacity for our household.0 -
