Arrested, Charged, Suspended, Dismissed, Acquitted..

Hi there,

First time posting and what a way to begin. I've had a eventful start to the year as you can imagine from the title. Having just been acquitted for an offence :jwhich I was innocent for, I am now exploring my options. When I was dismissed my representative helped me to lodge an appeal. The date for the appeal has been set for later this year and was thinking is it still worth attending the appeal?

What are my options in this situation? Do I have any grounds for wrongful dismissal, as my employer dismissed me based on their evidence, balance of probability whilst playing judge, jury and executioner:mad:. Are they within their rights to do so even if the ex-employee is later acquitted. What are my rights as it stands?

Any help would be much appreciated....On with the job hunting>>>

  • They can dismiss you if they genuinely thought you were probably guilty at the time, on the balance of probability. The standard of proof in a criminal court is much higher. If you were clearly innocent, just nicely ask your employer to re-instate you. They don't have to, but if you have been a good employee they may want you back.

    Alternately the OP may have been a bad employee and they took the chance to get rid, having said that if you have been aquitted it would be a brave employer to uphold the decision

    I wish it had happened in that short space of time. I was arrested at the beginning of the year for parking offence which I was later charged with. My employers were later informed by the police as employer parking permits were involved. I was then suspended pending thier own exquiries and then eventually at the disciplinery was dismissed for gross misconduct. I have just been acquitted in the crown court.

    It was an alleged fraud related parking offence.
