  • Hi ya,

What does your agreement say re BR? Does it say that Santander MAY terminate if you go BR?

Have you kept up to date on all your payments?

Do you wish to keep the car?

If you wish to keep the car, haven't missed ANY payments and it states that they MAY terminate, write to them. Say further to your telephone call regarding the termination of your agreement and your respective BR, you apologise that you should have notified them in the first instance to see where you stood, but as you wish to keep the car & that you haven't missed any payments since you took out the agreement you don't see why there is a problem. You are also aware that it will cost them to collect the car, that those monies will them be billed to you but will then then go into your BR, so they will be out of pocket... (If anyone else could just clarify that point - I'm presuming that HP repo is same as house repo and that shortfall etc will go into BR).

Not sure they can issue a default if you haven't missed any payments, but could terminate on breach of contract. Depends on what the wording in your agreement is.

My co. didn't cover BR so I called them up & they said providing that I kept up with my payments I could keep car.

State that the payments will be covered in your SOA agreed by the Official Receiver and that they will continue to be paid as in the past. (Just a change of bank details).

    Good luck.
