Resigning - Need Advice

After months of being seriously unhappy in my job and having time off ill because of it, the doctor has now signed me off sick for 2 weeks (potentially longer) with anxiety and depression. So I have sent in my sick note and also sent a resignation letter giving my one months notice.

Now I now how JSA works in terms of I wouldn't be entitled to it for 26 weeks as I left my job voluntarily, but would there be any other benefits I could claim as otherwise me and my husband would not be able to survive on his wages?

Hopefully it won't come to that though because I am trying to secure another job but I have to look at all possibilities

    Are you sure you're not entitled to JSA? If you left your job because it was making you ill, i think it would be worth talking to a benefits advisor about it. You might get it under hardship provision even if they don't agree about your reasons.

    Really, you need some professional advice!

    If you are unable to work through sickness then you should be able to claim incapacity benefit, providing you have paid enough in NI contributions. This isn't a means tested benefit like income support. You would need to send in sickness certificates to the dwp.

    People who haven't paid enough contributions can claim income support, but as you have a husband who is working you probably have too much money coming in to be able to claim.

    If there is a welfare rights advisor near you it may be an idea to get an appointment to find out your entitlement.
    The bigger the bargain, the better I feel.

    The depression is as a result of my unhappiness there, it has got gradually worse and worse - I managed to bury my head in the sand for so long and then I just reached breaking point.

  • Sorry to hear about your situation. Hope things improve for you. Given how much time is spent at work, it should not be a unhappy one.
  • Very bad move sending in a resignation note.
    My wife was in your situation, although it was not through depression but an accicent.
    She kept sending in her sick notes for almost a year before the company "retired" her on ill health grounds. She now gets DLA IIDB and IB.

    my husband has just been through similar.he has epilepsy and the stress of the job was causing more seizures.the doctor advised him to leave his job and the citizens advised to hand in notice at the same time as his sick note,so both would finish at the same time.also apply for income support and incapacit.he has just been awarded incapacity and we are waiting on income support.incapacity said he would have to get a sick note to send to them.i was also worried about handing in the notice but it seems they do still award you the benifits.he already gets disability living allowence and i get carers allowence which that will change if he gets income support.if that comes through ok we will also get full housing and council tax benifit.
  • I just resigned due to problems at work causing me severe stress/anxiety/depression. I had made a formal complaint about my line manager and they did nothing about it. After a further three months I decided that it was having such a bad affect on me that I had to get out.

    I contacted the jobcentre and they said that I may get contribution based JSA but will need to put everything in writing with the application and it will be assessed by a team that look into such things. I have copies of all of the letters etc. I have sent/recieved from my employers as evidence of how they have treated me and how I came to the decision that it was impossible for me to work for them.

    Give your local jobcentre a call - they were very helpful when I spoke to them about my situation.
