Advice re Debt Collection Agencys

I have been with a fee paying DM company, who charge me a considerable amount for the pleasure of using them and pay my creditors at there convenience meaning ive had numerous late payment letters.

After speaking to the NDA they advised me to go it alone so thought id give it ago and contacted my largest creditor first who where York Bank but there fake solicitors arm were dealing with this. Made agreement with them to pay on 28th of every month for the agreed figure, but due to "admin error"!!!! they took it on the 20th of this month putting me overdrawn so when i rang up to complain about this and getting past the usual 2are you in a position to make a payment line" ("no i bloody arent as youve already took it"), they informed this was there error, and would refund any charges (how nice of them, i have been living on beens on toast all week). They informed me they have sold this debt to a debt collection agency called Marlings, who i can look up on the internet.

Which i did and i was little concerned that the first came up was the channel 4 doc about them and there tactics.

Right i accept the debt is mine and was happy to pay it, my only gripe with YB was they never should of given me that much in the first place and maybe could of advised that everytime they look at the original perssonal loan and give me a little bit more, i wasnt actually renegotiating the existing loan i was taking out a new one and been charged higer interest to pay off the original loan.

Anyway my question is how do i proceed with this marlins as they sound quite aggressive, as i say im happy to pay it all in full it will jsut take time (unless i win the lottery), i dont want a CCJ agaisnt me and i dont want a baillifs turning up my parents out as they are elderly & ill and id rather they didnt have the stress of that.

Will this marlins agree to monthly payment agreements outside of court agreements or is it better to try to get my hands on lump sum cash amount to half the value of loan and make them an offer for a full & final settlement?

please advise if anyone can help.

    I would not try to get a loan. This is probably the last thing you want right now.

    Rather than going it alone, have you tried using one of the free debt charities - CCCS or Payplan? I'm not sure if there is a minimum amount that they require you to be able to put towards your payments but they will still be able to help with advice if you need to keep going it alone.

    The reason i suggest the charities rather than going it alone is that the financial organisations recognise them and are usually more willing to deal with them rather than individuals as they know they have a good reputation.

    You will not get bailiffs knocking at your door until you have gone to court and not made the payments required. If they have issued you with a default, this gives them the option of taking you to court, but does not mean they will.

  • well it wouldnt be a loan as of such more a cap in hand visit to the parents, which is not ideal.

    i spoke to this marlins and got a robotic response as they havent received anything from York Bank they cant advise how things will progress with them such as if they wiil accept monthly payments, couldnt even tell me if its something they do! they where also after my work contact number, which i told them no chance which they thought i was been akward with.

    did mention the first thing that come up when i type them into google was the dispatches programme about them, the girl did say that was a long time ago, but i get the feeling this is goin to be a stressfull few months in dealing with them.
