Responsibility for other people's debts

What is the situation vis-a-vis responsibility for other people's debts when they die. What happens? Are creditors sympathetic, or likely to puruse you and make your life a misery? And what is the legal postion? Can you actually be held legally responsible?

  • Hi cocom13w,

Some more knowledgeable people will be along shortly, but as far as I'm aware, your remaining family are held responsible for your debts.

All debts in a sole name which remain outstanding upon an individuals death are only payable from the remains if the deceased’s estate after reasonable funeral costs.

If there is no equity within the estate then the debts are unenforceable.

Debts which are in joint names, or where a sufficient amount of equity is left in the estate are dealt with differently, and some creditors are more sympathetic than others
 It’s hard enough remembering my opinions - without remembering my reasons for them
