  • Hi

First of all do not panic, this may actually work in your favour as a court will not make you pay any more than you can afford and if demonstrate you have been reasonable then this should work in your favour.

Have you received the court papers yet?

Don't worry too much about court proceedings although it's important that you complete all paperwork promptly, I'm not sure about the process involved, someone else will be along to help with that. However, make sure that you have copies of all letters that you have sent to Restons, regarding offers of payment plus their letters of refusal, a judge will not look too kindly on DCA's who do not accept reasonable offers, especially as you are currently unemployed and have offered what you can afford. You will probably have to complete a Statement Of Affairs for the court, Restons are aiming to obtain a County Court Judgement against you, but as you have requested a CCA, they cannot obtain a CCJ without it. Don't panic, no-one is going to lock you up or take your stuff if you pay what you are ordered, I reckon the judge will make you pay what you offered in the first place. Hold tight, someone will be along soon to give you more info...Good luck :)

  • Thanks Guys, I appreciate your help - court papers are not here yet - dreading those landing on the doorstep - I still can't get over how quick this has happened, maybe I just got the worst DCA out of them all - chin up - save my energy for the fight ahead :p I will let you know as soon as I get something through, and hopefully getting some more words of wisdom from you all. ;)
  • Hi again,

Just a couple of thoughts running through my head - if we decide to go down the DMP route do you have to include all you creditors, the only reason I ask is that I have a loan that is due to finish in the next 12 months with my bank, where I also have 2 smallish balances on my credit cards, both approx. £700 - I have been with them for over 20 years, problem free and would like to continue with them.

Look forward to hearing from you :)
