Arrears Timescale

Hi there.

My ex has two cases against him mine and another pwc

I am annoyed and upset that the csa are paying the arrears from the other case off sooner than mine. Should they be doing this?

I am owed over 6k and my case has been open for five and half years, the other case is owed hundreds and been open eighteen months if that.

My ex has just started paying the csa again(awaiting commital to prison again) and after current maintenance for both cases is paid there has been £48 left over to pay arrears. CSA are dividing this equally. When I asked why this was not divided on a ratio of the debt and to ensure both arrears are paid of to the same timescale they said, 'thats what the computer deems should be paid'. When I expressed my concerns at this the gentleman understood my reasoning but dismissed it because the csa don't work that way.

So how come one case gets paid quicker than another? Why is one child favoured over another?

    What your saying makes sense, but their computers can't handle the simplest of instructions let alone that.

    I have emailed my complaint in and CSA rang me today to 'sympathise' with me and can see the logic in what I was saying but the legislation for the csa says all money must be split equally between cases. However once the arrears on the other case had been paid off I would receive a larger amount.
    I explained I was not happy with the CSA favouring one child more, and that all arrears should be paid off on the same timescale not one sooner than the other.
    I was told to look under up the legislation for myself! Advised them I wouldn't and wanted them to present me with the legislation. They have been found not to follow their own policies when dealing with my case.
    I have told them I want the complaint escalating to the complaints team, which they are going to do.

    I agree with the responses to this thread, that common sense seems not to come into the equation with the CSA!

    im in a similar position regarding arrears however im the NRP the majority of my arrears are paid towards the higher debt

    Suppose on positive note, the other PWC arrears will be paid off in full soon, so then you will surely receive the full £48 toward your arrears

    I loved it paying my arrears back to the Secretary Of State

    This country needs the money now
