  • The original debt was in his name only and unsecured. The letter I received when I enquired about the charge remaining states....

    I can advise you that you are not liable for the debt incurred by ****..(LOL, he would not be impressed if i put his name on here..it may make the divorce even worse!!)

    which I take to mean that only his BI would be chargeable (but I will seek clarification now..thanks!!!). If I buy this does it mean that they cant take anything for the charge? I am really concerned tht they want to be involved in BI discussions, am I obligated to tell them? technically the debt isnt mine, and im fairly certain they wouldnt give me info on the loan if i asked since it isnt in my name!!!!

    Buying his BI does not make you liable but make sure you dont sign anything accepting reponsibility. Buying his BI also does not take him of the mortgage or the title deeds you are both still the owners of the property. Remember that if you are unsure you can just wait out the 3 years and then his BI gets given back to him.

    The OR wont sell the property until his BI is worth anything. If the charge is only on his BI then the property is going to need to be worth £148,000 or more before his BI is worth anything. Is that likely to happen in the next 3 years

    I have since heard that there is another charge that has been added....can they do this without giving me the chance to object?!?

    Also, his insolvency man has said I would become liable for the debt.....how is that fair!!!

    I really feel like giving up, but decided to fight so am keeping going!
