Advise needed

I work from home (1/2 of permi's market rate) due to lo...ng commute and family commitments(School going child).

With that employer for long(4+ years) supporting and enhancing IT application.
New technology upgrade rollout is underway replacing the technology that I am currently supporting. Hence asked to get into

that project(which was nearing deployment) and asked to provide some deliverables for the application which is not documented

properly.I was not trained in the new technology whereas others had undergone training and in that project for long. There

were known infrastructure failures / support team's mistakes which contributed some delays

In spite of all the issues sent across the deliverables to other team members / got the feedback and they were happy with my

work.The manager blamed that I have not done any delivery in last few months.He did not mention any system infrastructure

problem and invited for a HR meeting.
I explained all the details provided evidences in that meeting. I gave them as print outs during HR hearing. No printouts

were taken from me as evidence of proofs.


They decided that I will be issued with warning and i need to work in the office for initial five days ( 6 am -10 pm -

commute and office time together) (which can be extended).
They wanted me to start working in the office from the same day of hearing. But considering my personal situation,I was asked

to start 2 days after.I said Ok and left, came and applied for leave in the system.

What are the consequences of resigning now(before appeal) and fight later( then appeal/take legal action).How this would

affect the references?

If I resign now how this would be seen, I accept and resign/I don't accept and resign/

What are consequences of me applying for a leave in the system...did that mean I agreed for their warning...

I can easily get a new job. I am worried about reference.
Any help and advice much appreciated.

    What do they want you to come into the office for, for five days? Maybe it's so you can have the training the other staff had? That sounds like a good thing to me.

    Or do you think they are changing you permanently from a home worker to an office-based worker?

    Pain - undergoing pressure because of office politics. Nothing else.

    Training front - Nothing really.The manager used to say most of the time during 1 to 1 meetings, if he decides he can make me to come and work in the office and desperately trying for that by giving false inputs.

    I wanted to know employee' rights and time scale. Now I have some idea.

    So I won't be checking this thread anymore. Please do not post any response.

    fo info, you do not get to choose whether you accept a warning, it is given to you. you may have a right of appeal.

    I don't think the OP wanted advice - just telling that what she wanted to do was going to lead to a nice juicy settlement. She has obviously been told that somewhere. And she likes the advice. The fact that the advice is almost certainly incorrect will no doubt become clear if she is stupid enough to resign and "begin legal action".

    Occupational skill :) If you think we hear some whoppers on here, you should hear some of the ones that I hear in Chambers!
  • I am not behind money/compensation/juicy settlements...Most of the comments are based on assumptions made by narrow minded people.

    I was punished which I strongly believe that I don't deserve. So I want to 'clear my name'(don't want to leave with negative impression/mark on my record), make sure to get 'positive reference' and leave the company. That's it.

    Anyone can speculate anything which could make them feel very happy and satisfied with their responses.

    How is it speculating when you are the one who suggested taking legal action against a disciplinary outcome? That isn't "getting a positive reference and leaving the company", is it. You came on, asked for advice and 20 minutes later said don't bother giving me any advice because I won't be checking the thread. It doesn't actually suggest anything other than what was assumed.

    Perhaps if you don't like the website you should stop posting on it or reading it? Nobody has ever pretended that there are not employees who think that there is a main chance in taking legal action against the employer (the reality often times being very different), and inevitably some of these will end up on such forums. Whether they are "scum" or not is a matter of opinion (yours) - there are just as many if not more "scum" amongst employers. If people are taking the !!!! or attempting to manipulate advice to suit what they think the outcome ought to be, then it's fair enough, in my opinion, to point this out. But if it offends you so much to have people who don't fit your view of the world here at all - perhaps you should save yourself the stress and go away?

    It has been pointed out to the OP that she is being unreasonable in her method of dealing with this issue (whether or not the performance disciplinary was reasonable isn't relevant - it's a fact), and putting her job at risk, and that there is no legal action that she could take that would not blow up in her face. If she wants to take or ignore that advice it's up to her.
