    Totally agree with posts 10 and 11, the debt is statute barred and unenforceable.
    Upto you with what letter you want to send to westcrap, if you want it over and done with, send the statute barred letter, if you like playing with them like I do, send the prove it letter.

    update:

    I have been send statements of some sort.

    Opened as a student account then sometime in 2008 changed to a 'bank account + personal overdraft'.

    19 Aug 08 there was a 'payment' of £22 for a reserve fee (something Barclays do if you go over your overdraft or something)
    24 Sep 08 that payment was returned so 'receipts' £22.00c
    I then have 8 'payments' of interest.
    17 Aug 09 I have a 'receipt' of £224.31c takng my balance to £0.00 and a/c closed

    I am not sure what to make of all this!
  • When you say payments, are these payments you made.

    Or is this just interest or money that barclays paid into the account. If these are not payments by yourself then they do not affect the statute barred date. Statute barred is only affected by your actions.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    So they don't seem to be reading my letters. Had the same one sent 2 months after the first and now have had a letter about 'door step collectors' only problem they have apart from it being statute barred is that they are senting everything to my old address regardless of me sending letters from the new address. This letter was sent 19/10/2010 so my 2nd statute barred letter was sent to them after this date. Only got this letter yesterday as the old residents dropped it off. Next time I'll just return to sender 'not at this address'.

    You've sent the statute barred letter, so ignore them now. If it is SB, they've got no chance of taking you to court, and they've already done the worst they can and defaulted you.

    Wescot have finally gotten back to me (still using my old address) to say that they are going back to Barclay's with what I have told them
