Hello,
We have Red DCA/Lowells chasing us for a debt which isn't ours. We sent the "prove it" template letter from this site.
We have today received a letter stating the following:

'Since our last letter we have not received payment. Unless we hear from you about repayment, we will obtain a copy of your credit file and review it. This will help us understand your ability to pay.
Based on this we could instruct Hamptons legal to use the court system to recover money owed.
We would obviously prefer you to call us so we dont have to use litigation.'

We were warned on here not to call them to explain. Should we still not call? There was a misunderstanding over the debt as such:
My partner paid the p&p for her friend to get a free phone on 3 contract. Her friend ran up a debt on the contract, but 3 kept my partners name on the account, hence the chasing, and they must have sold the debt to Red/Lowells...Contact with the friend has resulted in nothing. She has denied knowledge..nice!!
What do you suggest we do next?

Hi Im no expert in these matters but Im sure someone will advise but if your wifes name is on the contract Im not sure there is much you can do other than you trying to get the money off a so called friend have they responded in any shape or form and do you have a copy of the contract

If they can't prove the debt to you and your wife then how do they plan to prove it to a court?

Did you just send the first letter? I think there's another one you send after the 12+2 days are up - but don't quote me.

you should be able to find it on never in doubts useful post - (don't have the linky atm sorry)
