Ok we are off, just been on the phone to my local BR court and the forms are in the post, does anyone know if once the judge has declared you BR that is it for your debts and anyone chasing payment can be told you have been declared BR or do you have to wait til after you have seen the O.R. ? also I have never been to court before, Will we be able to take the kids ? We have no family to look after them in the area, or would this be frowned on by the court.

Nope once the papers are presented & signed in court thats it...your officially bankrupt & if a creditor calls just tell them your court number ***/2010 your court & OR details
the receiver will contact all creditors within 8wks or so afterwards anyhoo
kids? not the greatest of places to take them to be honest the court wont mind but you could be looking at anything from half an hour to a few hours depending on the court..so plenty to keep them amused!We all die. The goal isn't to live forever, the goal is to create something that will0 -

have you had some advice though 1st from cccs/nationaldebtline/cab?
its a question the courts WILL ask if you aint then they could refuse your petition
for fees...

We are using the national debt line they said to call back if we decided to go br and the would help. another question I have tho is will all debts even small £200 be written off ?0 -

Yes all unsecured debts will be written off, there are a couple of exceptions like a student loan, can`t remember the others (sorry) that cannot be included.:pB&SC No. 298

The exceptions are:
Court fines i.e speeding tickets but not parking fines. Those can go in.
CSA
Student Loans
Tax credit & other benefit overpayments if gain fraudently (i.e not notifying of change of circumstances). Most overpayments have to be proven that they were in error on not your fault.
Think that's it.
Also as per you other thread, I wouldn't tell any creditors that you are going BR as they will just pump up the calls for money to get what they can before Br day.BSC 289A life lived in fear is a life not living!Proud to have dealt with my debts.0 -
If the parking fine is issued by the Police then you cannot include this, if it is issued by the local authority then this can go in the BR. I actually had one issued by the LA and was allowed to include it, but was told by the OR if it had been issued by the Police then I would have had to pay it.:pB&SC No. 298
