Called Santander who - as the matter was in solicitors hands could not accept payments or negotiate repyaments.
I then contacted the solictor representing Santander and offered £600 today with a higher monthly installment.
they declined stating that the only way to avoid court is to pay the full £6000 odd remaining or surrender the car. both options are not suitable.
i then stated that i would be willing to give this offer in court to a judge to which she replied this would be sensible as we have never defaulted before
and that a suspended repo order be made on the grounds we pay a higher installment and stick to it.
i have no problems with this and if this is the actual conclusion in court, i will be happy.

It is very likely, given what you have paid to date and the sensible offer you have made, that a suspended order will be made which will mean that provided you stick to the arrangement you will keep the car.
It is unfortunate though that the company does not have the common sense to sort this now by accepting the £600 goodwill gesture and giving the arrangement a chance without court action.
After court, keep strictly to the arrangement and you will keep the car. Default on the arrangement and they will send in the bailiffs for the car.0 -

Can I ask how quickly you got the letter about going to court from santander? And was it from santander itself or a company working for santander?0
