Confused Need Help!

hello there,

in abit of a situation

im married to my wife who we have a 2 year daughter together but she had a child who is now 5 to someone else before we met,

they split when there daughter was 2 and he see's he when he feels like it,
(can be months sometimes)

he started to pay £20 a week from when she was around 4,

ive told my wiife on numerous occasions to get CSA involved but shes adament she wouldnt be better off,

i recieve 22k a year and we get working tax and child tax benefit at 80 pound a week also.....

if she called CSA would our benefits stop, would it be worthwhile,

were very short on money at the moment and struggling.

    are the responsibilities of fatherhood, £20 a month (per child)?

    I can't believe that this is the correct sum, and that the CSA is not the best place to start. I'm sure the experts in this great forum will give you chapter and verse. Good Luck.

    Is the father working? If not and he's receiving benefits, he would pay approx £5 a week out of his IS or JSA. (it may have gone up slightly, to approx £6 a week, judging by some recent posts on here)

    If he's working, you could well get more than £20 a month, but it would not effect any benefits you get. They changed the rules back in May.

    Rather than going straight to the CSA, why doesn't your partner approach him (in person or writing) and ask for an increase? If he'll willingly increase it, you wont need to involve the CSA then.

    sorry yes her ex is working,

    apparentley shes asked but he said no,

    and my partner is scared has his family have abit of a criminal past, ive told her not to worry,

    i think its a joke he pays £20 a month , sometimes he dosent buy for xmas etc

  • So if he's working she would expect to get more, but it will depend on whether he's on PAYE. If he's self employed its harder.

    eta just saw your last post. Does she know how much he earns?

    Earlier this year there was a change to the rules. Child maintenance no longer effects means tested benefits.

    i dont know , he must earn quite abit has he can afford a lavish lifestyle as we struggle to put food on the table

    When it started, was your partner on Income Support? Could it have been that she only had £20 a week off of him because anymore would have affected any benefits she received (if any)?

    It depends on how much he earns as to whether she would get more. Obviously, £20 a month is a lot different to £20 a week. lol

    If she knows approx how much he earns, then she can use the online CSA calculator to see if she would get more and if it's worth going to the CSA.

    To pay£20 a week through the CSA, you would be earning approx £160 a week NET. If he earns more, then she would receive more. (If he's a PAYE employee as a previous person said. If he's self employed then it could be more difficult.)
