SAR - Natwest

I sent a SAR request including postal order to Natwest on the 7th July, for my current account. The request included photocopies of a utility bill and a photo card driving license.

They have only just responded and sent back a strange letter acknowledging receipt of my letter and fee.

However, it states :
- To ensure that we are releasing the account information to the correct party we need to verify your signature, in order that we can deal with your request please visit your local branch to have a member of staff update your signature.

It goes on to state that:
- Please be aware that it is not our practise to provide further copies of standard documents that you would have received as part of our normal course of business. This would include providing you with further copy statements. However, if you do wish us to include copy statements, please advise us at your earliest convenience. Please also confirm the statement period you wish this to cover.

My original request asked was a SAR requesting:
- Full copies of all contracts...
- A complete list of all transactions or statements...
- Copies of all documents which include personal info...
- Full copies or transcripts of any computer logs...
- Full copies of any and all correspondence...
- Telephone recordings...

Did I shoot myself in the foot by not signing the original SAR letter?

What is their point about not sending standard documents that I would have received as part of our normal course of business?!?! :rotfl:
I don't receive paper statements and internet access to my current account has been withdrawn!!

Any advice?

Your signature is already on your photocard driving license , i would not give them anything else , they know who they are dealing with , send A LETTER GIVING THEM SEVEN DAYS TO PRODUCE YOUR FULL SUBJECT ACCESS REQUEST , State firmly failure to comply with your request will result in their default being reported to the financial authaurities , you also reserve the right to take legal action .

They had forty days to comply with your SAR , they are now in default , they are hoping you do not know what you are doing , keep all letters from them including envelopes , send everything recorded delivery use post office track and trace download delivery date and signature , post back after sending them the ultimatum .

Not sure if sending them a copy of your driving licence was a good move, they could copy your signature from it, utility bill, was good enough, aswrinkles said, send them the letter, and nothing else.

I thought it was 40 working days?

In which case, aren't they in breach early September?

Thanks for the advice so far. I thought you had to send a piece of identification with signature for a SAR request, hence sending them a copy of my license.

I'm not doubting the agreement on the account, I just need to know how many hundreds of pounds in interest and charges they are applying each month!

They have forty days from the date of getting your letter , they have to send all the information they have on you , they are probably frightened you may be looking at unenforceabillity , whatever your motive we are non judgemental and will give you advice , if you ask .

Ah so they are in breach today. They left it late to send the letter!

I no longer use the account but there is a large overdraft. (It was at least £11K authorised)

My current employer accidentally paid my expenses into the account, after I informed them of a change of bank!!! They are now chasing me for the payment.

I just need to get a summary of how the money 'disappeared'. I just want to know how much interest and charges are being applied to the account. I suspect it may be £££s.

You don't need a copy of all statements (for which they will probably try to charge you £5 per copy:mad:) all you need is the complete list of transactions which you have already requested. As others have said, they should not need any further proof of who you are, you have sent in enough. I recently requested my SAR from Northern Rock and I didn't send any proof of identity. I did sign the letter but as the account is in my husband's name, I signed for him. (With his consent, obviously!)
This is just stalling tactics, I would send them this letter...

    http://forums.moneysavingexpert.com/showpost.html?p=33791933&postcount=24

and just change the bit at the end about enclosing the fee and giving them 40 days, etc etc. I would give them 7 days, reminding them that they are in breach of the law already, if they know that you are well informed, they may get their a**es in gear!
"I may be many things but not being indiscreet isn't one of them"
  • Well I stuck to my guns and sent them the following:

"Many thanks....you are now in breach....etc
You have not complied with the Data Protection Act 1998....
If you do not comply fully with my SAR within 7 days, I will complain to the ICO...."

They are completely ignoring the request and I have no idea how much interest and charges are being applied every month

I sent my letter recorded on the 20th August.

Any advice, as always, is gratefully received...............
  • Anyone?

Is my best course of action a letter to the ICO?
