NRP - Do I include my son's DLA in CSA financial statement?

Hi,

As it says really, I am NRP's partner. We have a son who is disabled and we claim DLA for him. Do I have to include this in the household income for the assessment?

I know I have to declare our child tax credits but wondered about DLA?

    I'm sorry but I think you do :(

    However I have been wrong at least once today so it's always worth phoning the CSA and checking - you don't have to give your name.

    If the DLA is in your Son's name then no you don't.

    As that is in your Son's name (as oppose to tax credits which are in your/your partner's) then it cannot be used.

    Hi we are on CS2. DLA is exempt from CSA assessment as it is your childs benefit, and so is carers allowance as long as it is you that claims it. If you claim the disability elements from child tax credit then this should be declared to CSA. We recently had a change of circs due to this and our CS payments went up by £50 roughly per month.

    :) DLA is not included in a CSA assessment..it is your sons in his own right and therefore non-deductable...

    Thanks for all your replies. I phoned them up in the end, told them the situation re my son's DLA, my CA & CB.

    They agreed that unfortunately the enitre tax credits will be assessed, but the DLA, CA will only be used as in to show that we have a child with disabilbites and therefore given a higher protected income. The actual figures will not be used in the assessment.

    They also said that CB wasn't used as the PWC already receives it and it's not fair for them to receive it twice - as it's awarded for the children.

    I've sent of forms as I said I didn't want to do it over phone but will write in with SOA & covering letter. So waiting to hear from them.

    I'll keep you posted on outcome.
