Child now living with NRP - What happens now?

    I'm confused - does your OH have an income or does he stay at home looking after the children (or possibly work part time?)

    Will your son be visiting at all? If you see him for 52 nights a year (once a week) then you'll get a 1/7th reduction - for 104 nights or twice a week, 2/7th reduction and so on. Obviously you will still be paying out for food etc during his visits so although your child maintenance may decrease, the direct costs of having him will increase.

    Don't forget you don't have to go through the CSA. You could also start seriously hassling the CSA for your back payments.
  • My OH works part time in the evenings and then looks after the children in the day whilst I am at work. However he would have to go full time for us to afford to pay maintenance. I am not sure how regular my son will stay here at the moment as he only moved out this week.

    The CSA took the case to court last month who have instructed court balliffs to obtain the debt. I dont think they will be very successful as he doesnt own anything of value.

    Also, easy to say I know....but no point stressing, the PWC hasn't given any indication that he will be asking for maintenance.

    Nothing wrong with checking, but no point stressing ;)

    Actually there has been a recent change in the law, and if he owes you, you will not pay child maintenance, the arrears can be offset.

    Just make sure if you are contacted about a new claim, that you let them know that you are owed back money.

    Doesn't the PWC work? If so, then why can't the CSA do an attachment to earnings?
  • Does anyone know if any housing benefit/council tax claim would take into account any maintenance I will be paying out?

    Could you give me a link to this Lil as this has definitely not been true in the past and it is information that could be useful :)

    He is self employed so they cannot do a DOE.
