little bit of advise please

Hi all - had the CC company on to me tonight threatening/cajolling me for payment - got made redundant back in feb on thought the payments would be protected but they were not so I'm in the process of reclaiming the PPI which will probably come to around 2K (I owe 5K), apart from a payment I made last month by borrowing off my brother I havent paid a payment since Feb so now the calls are starting again but I honestly havent got any money for the repayment this month - they did ask last month if any family members could help out and my mother has agreed to lend me £1000 and I did tell them this in the hope that they would accept it has a final settlement but they said no over the phone (but would be happy to accept it has payment off the balance) so my questions are;

do I put the offer of £1000 in writing and adress it to the company?

they asked me to do a financial account? including my wifes salary - although its nothing to do with my wife and tbh if she knew about the debt it would end in divorce anyway

I've had the CC for about 6 years - how does the CCA I've read about on here work? - sorry may be clutching at straws here

I've started a unpaid job for experiance so had to stop claiming JSA so basically my incomings are zero and outgoings are £20 for virgin broadband and £15 a month for my mobile phone - I've been doing a bit of buying and selling on ebay that maybe adds up to £100 a month

please any help would be really appreciated here, many thanks

ps - I read somewhere on another thread that you can request they dont phone you only by post - how do I do this? again many thanks

    Hi willworkforfood,

    You should probably send the credit card company a token payment of £1. They won't like it, but if thats all you can afford, then that's all you can afford and they can't bully you into paying more at the moment. Regarding the financial statement, it's got nothing to do with them what your wife earns and you should only provide your details (if any). I'm not sure posting your statement of affairs will benefit at the moment as you've got no income, but you may wish to consider it. The next time the credit card company call tell them you only want contacted in writing and send the letter below. Hopefully someone with more knowledge/advice than me will be along soon.

    I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

    If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.
