Debt sold on to Cabot

I've just sent a prove it letter to Cabot as they sent me a charming letter this week telling me that I haven't made the first payment of the arrangement I have with them for my Sainsbury's CC. No such arrangement was ever made however I do know about this debt. Until June 1st I was paying them £10 a month via a doorstep collector for Moorcroft. He came in June as expected and said it had been returned to Sainsburys and just to sit tight till I heard from them. He marked the payment card as such. I don't have a problem with paying this debt, I owe it, I will pay it back but the letter from Cabot is inaccurate (no arrangement was made), my address isn't quite right and has a different amount on it from the last balance on the payment card, only £14.16 out but different nonetheless.

I was under the impression I was supposed to get some letter from either Moorcroft or Sainsbury's to say the debt has been sold on. Am I wrong? And have Cabot put a charge of £14.16 on the account?

    I just wanted to make sure I had my facts right before I contact either party. I thought an OC had to tell you if they had sold the debt on. Obviously if I ask them they will just say that they haven't done anything wrong. I'm also unsure whether a DCA can add charges to an account. Maybe someone could link me to another thread:), but I searched and couldn't find anything relevant.

    If a debt is actually sold, then yes. A notice of assignment (NOC) must be sent to you from the original creditor and generally a confirmation from the new owner.

    However if a DCA has just taken over responsibility for collection, i.e. they are not actually the new owner then, they will just send out copy/paste demands for payment... as they do.
    It is likely that the debt has not been sold, just issued to a different collector which is odd if you are making payment already.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    I actually saw the guy who used to collect this from me and asked him if he knew what it all meant. He said don't speak to Cabot, it will probably end up back with him as he does collect for them. He thought that Sainsburys took it back from Moorcroft cos they wanted more money each month, but as he conceded, they can't have what I haven't got. Just a bit p*ssed off that they take the debt back then accuse me of not keeping to the arrangement!!! :mad:
