Hi, I had a catalogue account which defaulted in 2007. The account was initially opened in 2006. There is a balance of about £1000 remaining.
I contacted the debt collector for the CCA using the template letters on this site. They've confirmed they don't have a copy of the original CCA so I presume I could easily go down the unenforceable route.
I want the default removed from my credit report though, so was thinking of offering them a percentage of the debt and asking them to remove it completely based on the fact that I could go down the unenforceability route anyway.
Does anyone have any opinions on how successful this might be, because I'd rather avoid any future hassle from them if possible and don't mind paying as I do actually owe the money...

Now you have a default already there is little disadvantage for not paying and going down the CCA route. As the default will do the damage not the missed payment markers.
I would say its very uncommon for a DCA to remove a default, but people have tried and worded it into F&F settlement offers, and in some cases it has been accepted. Their lack of CCA will indeed add weight to your arguement.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
