Advice with job- may get sacked :-(

Hiya, im looking for some advice for my aunty who is in a sticky situation!

She works in an amusements/tanning salon very near to home and walks to work every day. A newer member of staff accused her and another colleague of bullying and they were both suspended. Upon investigating all colleagues said no bullying had taken place and that the woman accusing had said she "was going to take the company for everything" and went on the sick for months.

They brought my aunty and other colleague back to say they believe she had been bullying and that she needed to move to another shop even though the woman no longer worked there and they had no evidence.

The problem is the shop they are moving to is hard to get to and about 8 miles away. It does say in her contract that they can move her to a shop in 'the geograohical region' however it will mean her getting 2 buses with no extra pay. She is a single mum working full time and I no myself her outgoings are nearly matched to incomings!

The other thing is that they have refused her monthly bonus and gave her several reasons as to why she no longer qualifies!

Just looking for some advice from you wonderful people!x

  • Well to be honest if she has been accused of bullying by her employer and not just the member of staff ie I am sure an investigation must have taken place and they have moved her instead of sacking her then she should feel lucky and learn you behave like a bully your life will be made rather difficult. However I think this may need bumping to the employers thread etc ect

    The employer hasnt accused her of bullying as there was no evidence and the other members of staff had told them no bullying had took place! Only the member of staff accused her!

    I'm afraid if her contract states that they can move her then it is legal and no compensation would be due. Whether she should get the bonus is a different matter but I'd guess that they award it at their discretion so basically they can withold it if they want to. If she's being treated differently to others then she may have a case but I'd very much doubt she'd win so its probably not worth pursuing.

    I think the key problem is the work she is doing is relatively unskilled so she has little negotiation room. If she left they wouldn't struggle to fill the post so they have little incentive to look after her beyond the minimum.

    It isn't fair treatment but from what you've said she wouldn't have a case at tribunal. It may be her best bet is to commute for now and look for other work.

    Yes, what happycamel said. I'd also look for another job ASAP, I wouldn't like to work for anyone who didn't believe what I said!! Also if she is having a struggle with her budget, if she posted an SOA (statement of affairs) on here, there are many who could help her and advise on budgeting:)
