DWP Advice please

I have been paying DWP £20 a month for a while now. The balanced left to pay is £1864.08. Every so often I get letters asking to increase my monthly payments to £75 which I cannot afford at the moment.

Today I have received a letter stating:-

Thank you for your payment of £20.00 which we received on 03/08/2010.

The minimum amount we would expect to receive on a monthly basis is based on the amount owed. We would therefore expect you to pay us £75.00 on a monthly basis.

If we do not receive contact by 12/08/2010 we may take civil proceedings to recover the money owed. Civil proceedings will result in the addition of court costs to the money already owed and may affect future credit ratings.

This amount owed is from 16 years ago when I had split up from my childrens father and went onto income support. During that time I had a major fight with the CSA which took them 2 years to sort out maintenance. Maintenance was eventually sorted out and backdated which therefore resulted in an overpayment of IS of around 6 months worth. I then got myself a job and never heard anything from anyone about the overpayment. The ex only paid a couple of maintenance payments then disappeared off the face of the earth.

Anyway the first I knew of this overpayment was when I split with my hubby and claimed JSA. Bang then came the letters so rather stupidly I agreed to pay £20 a month. I got myself a job and I am doing my own DMP, I dont have alot of debt left so once the 2 debt collection agencies and the CC are paid off then I was going to tackle this debt.

Any advice please because at the moment I cannot afford £75 a month.

    Simply write back to them again and state as you have done before. You are on a DMP and the most that you can afford to repay is £20.

    Send in a budget sheet to prove this is the most you can afford.

    DWP won't go away, and are a law on to themselves. They should however still be reasonable on repayments.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

    It's unusual for DWP to statrt a court claim but, if they do, you fill inthe paperwork justifying a £20 per month payment (court rules take 50-66% of available income) and return it.The court should order you to pay that, and so the DWP would have achieved very little
