DPF received but vital info missing

Is it possible I haven't received the full DPF? In my request, I didn't refer to it as a DPF, rather I asked for my CSA file.

I recall several very specific conversations with the CSA and these calls are not in the file. I also noticed that a fax I sent to the CSA with a copy of an important document attached, is not in the file. (the cover fax sheet is though). So, I am wondering if they have only pulled out bits and pieces?

With an upcoming tribunal, I believe that certain bits of information and conversations would be vital, but are missing from the DPF. Anything suggestions on what to do?

    I'm not sure PHB, but I do think that the DPF will contain further information. The reason I say this, I had a malicious report filed against me several years ago by an unsavoury neighbour - They did show me information on file, but withheld some, stating that I'd need to ask for a DPF to obtain all information. In the end, they told me to save my £10 and verbally confirmed what I needed to know. It could be that whoever provided the file to you couldn't be bothered crossing out 'names' of any other parties or reference to things that they didn't want to divulge back to you - and so just didn't include any copy with the information crossed out. Bizarre seeing as you had provided the info initially.....but who knows with some of the agencies and following 'exact' rules etc. Have you called and asked them about the missing information?

    This also happened to us, they lost over 100 pages of bank statements which proved our income was not as CSA said it was!! Or in a nutshell, my hubs is not on Richard Branson's wage as they assessed him as.

    We complained to Data Protection Manager on 3 occasions, they did find and send other bits and pieces, but not the info we knew was in the DP File. In end we went to ICO who concluded that in our case CSA were in breach of 6th & 7th Principles of Data Protection Act - to you and I this means they were over 40 day deadline in providing the info, and have either 'mistakenly destroyed' or 'lost' our documents. We are in process of compiling a total complaint with this as one element so see what, but if they cannot provide you with your documents and are proven to have breached law, then ICO have e-mailed us the process for taking CSA to small claims court, whereby they say up to £5000 can be awarded.

    Just to add, we did receive a letter from CSA admitting they had 'lost' our documents and there was no further action they could take to correct the situation - that was of course continue with an incorrect assessment on back of our bank statements being lost, then enforce it to LO, CCJ and charge on house!! Just as well we were able to get copies for the Tribunal

    appaling! So, they can be proven inept, but then can fall back on 'lost your documents, sorry'?

    Exactly!!!!!!!!! But our timing of hitting them with everything will be a master thing!

    Our case has/is a complex one, we have files and files of evidence as we have become (or forced to be through no choice) CSA research anoraks. We have trickled them bits of small complaints at present, until everything from Tribunal is in writing and concrete (ie letter from CSA regarding LO, CCJ, charge on house for arrears not owed) then we will hit hard and fast with complaint, ICO, ICE, MP, Omudsman, SL, etc etc, we are awaitng the right moment to hit back ,and we will, they have ruined the last 4 years of our family life. Not after compensation, we just after justice and recognition, how the bully tactics and incompetence are astounding, as are enforcement of unproven arrears.

    As said we pay regular CS, just cannot believe if I performed as inefficiently or made such major (or any) mistakes at work, I would be hauled in front of disciplinary hearing, yet a CSA REP NAMED Rae Norris from Enforcement rang my husband on Christmas Eve 2008 demanding/shouting when the £34,000 my hubs owed his ex would be paid, and had we managed to get a re-mortgage? Unbelieveable! Rae Norris knew we have 4 children in the household to start with and he knew the arrears were under appeal - hope that man rots, and apparently he did not follow his 'white collar' code of working so we can take against him personally -guess what he was paid bonus on collection of arrears - sorry just we had/have an awful time and we bitter about certain elements
