Unfair Bank Charges

I am in the process of trying to reclaim some severe bank charges (total £140+ last month for a few small transaactions taking me over my O/D limit - Not the first time I might add)
I have used the FOI Act to ask for the last 6 years charges - they have replied stating that they will supply what they currently have available - free within 40 days - OK so far.
However, the majority of charges would appear to be "archived" on microfiche and guess what? - quite large charges to obtain this info - archived data not covered under the FOI they say.
Has anyone else had this experience and, if so, what is the position here? Also, and what did you do?
Any help greatly appreciated.

I am afraid I can't give you an answer BUT go to the penalty charges website and they have a forum where the mods know everything there is to know on the subject and you may find your answer on there without asking. There are also lots of threads regarding info stored on microfiche, but I think the general consensus is that it is still their duty to release this information to you under Data Protection requests - Someone will correct me if I'm wrong.

The Creditor at present has responded to you stating that hey will provide the information in compliance with their obligations under S.7 of the Data Protection act. However, most data controllers are still using the microfiche argument to refrain from providing older data as it is not from source as covered by the data protection act. ( i.e “unbundled” or “unsorted” ) this data is not encompassed within the act, and this has been tested by various case law.
The Information Commissioners Office are currently re-visiting this issue and a ruling is expected shortly, however even once the ICO have given their input it will take a further test case to force data controllers to comply.
For the interim all you can do is respond to the data controller and ask nicely again, they are in some cases providing microfiche data ( which is all good, as if they do go to court this will undermine their wider case):rolleyes: It’s hard enough remembering my opinions - without remembering my reasons for them :rolleyes:0
