3 Mobile Default Notice

Hi, im sure the same kind of question has been asked many times before, however please can somebody help me!

I took out a 3 mobile internet dongle, however cancelled the direct debit as it didnt work and I was getting nowhere asking for their help or a replacement. I received one bill requesting a payment of 15.00GBP which I ignored, this was back in 2008, and no other letters at all.

Recently I did a credit check and found that 3G had issued a default against my name for 35.00GBP.

I wrote to 3G and requested a signed copy of the default notice, and they have advised they are unable to provide me with this, but will send me the bill for 35.00GBP.

I am now wondering if this is correct? Are they obliged to send me the default notice? I can pay off the remaining balance, however I just want to clear the default. Is there any way around this?

  • I think the polite reply would be:
    There's no way to wipe off your error of judgement, a default will stay on your file.
    I had an issue with another mobile company and fraud. I found out recently that I have a defual going back 5yrs - because I cant provide the fraud paperwork they cleared the balance but left the default!
    So yours will stay on there for the six years. A bit of an oversight for £35 if you want to be credit clean....
    Treat Credit Agreements with respect.
    I didnt and now I'm paying for it, believe me. But mine wasnt for £35.
  • I know it was stupid of me being so naive but obviously didnt realise the reprecautions from it!

    Oh well 4 years to wait :(

    The world of Credit is a murky horrible place if you dont watch out.
    I've bitten all the bad apples since I was 18...
    I'm 36 next week and still feeling sick from them, even now.
  • If 3 weren't providing the service they promised did you cancel the contract as you'd be entitled to? Did you actually speak to 3 regarding the bill or completely ignore it? How much help did they try to offer?

    You could offer to pay the £35 but make it a condition that the default is removed. Afterall, people have been known to have defaults removed if no default notice can be provided by the company...

    I called and asked how much it would be to cancel my contract and they wanted over £100 even though there was only about 3 months left (£15 a month). I explained it wasnt working and they advised there was nothing wrong with the dongle as it was showing as connected was my pc. Called back again complaining about it and apparantly there was no notes on my file to say I had ever called. So in the end just cancelled the direct debit. So my own fault really for not doing things properly.

    Do phone/internet companies have to prove they sent you a default notice in the first place?
  • To be honest I'm not sure but I don't see why they shouldn't have to prove it.

    As nothing was done in writing at the time, it might be worth a letter now stating the case and that you'd pay the £35 for removal of the default? Sorry I can't be of more help. Sounds like 3 didn't do anywhere near enough to help but without any proof on either end (if they were telling the truth) then I'm not sure a lot can be done.
