Are we likely to get a CCJ??

Hi guys!
The Mrs has cancelled the wrong DD in our joint account. She cancelled our Council Tax DD, rather than another with a similar name.
The title says it all, Are we likely to get a CCJ for missing one months council tax payment? We haven't heard from the council as of yet and I don't have the funds to pay it now and am a little worried.
I declared myself Bankrupt in Feb '08 and have been using my Vanquis credit card to good affect every month, clearing the balance at the end of every month; so to improve my credit rating. I really don't want any set backs.

I don't think they will go for a CCJ just for one missed payment. You'll get a letter saying you owe x amount arrears, therefore the whole amount is now due!!! I get one with boring regularity, as they don't like me paying over 12 months with a SO - they want me to pay by DD!! They will get shirty if you keep missing payments though, so I'd write to them explaining the mistake, and if possible, informing them when it will be rectified. Or ask if you can increase the remaining payments to take account of the missing one? Do you pay over 12 months? As the monthly payments will be slightly less, if you're not fussed about the 2 "free" months.0

We had CT arrears, they sent us a reminder when we had missed two months then after three it went to court for a liability order (I think thats what it was called) and they then sent a Bailiff round (Bristow and Sutor) and I made an arrangement to pay with them. No mention of CCJs at all

Your council may permit you to go into month 11 (1st February 2011) to make up the missing payment if you have a word with them.
Unless it has changed you normally only get ONE reminder and after that, any missing payments would mean the whole year is payable straight away and extra costs could be added to any enforcement action!!0 -
You're lucky cats, we just get the "give us the arrears and all the rest" letter straight away!! I suppose it varies between different councils. Its always best to write and inform them though, that way you cannot be accused of ignoring them if it ever gets further! They will be the ones that will look unreasonable if you have kept them informed and come up with some sort of plan to repay the arrears.0

No you will not get a CCJ, i can guarantee that 100%.
The reason being that the council get a liability order (LO) not a CCJ for council tax arrears.
Paying per month is a privilege not a right for council tax, what is possible is the council demands the remainder of this years payments in full. Although if you get in touch with the council I would not be surprised if they just accept a problem had happened and allow you to correct it, we are human after all.
My mums bank account has about 8 different DDs setup for the council tax alone, I assume the council here (Staffordshire) like to change the DD yearly... leaving the old DD as unused.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
you should ask them if you can catch up with it in feb (if its a free month like we have heer) - if not you wont get a ccj they will pass it to sherriff officer and then arrest wages if you do not pay0

My council take you to the Magistrates court and not the County court.DMP member no 390

I agree that if you talk to them they should set up a new plan to finish in month 11.
The other point is that you may be able to pay by credit card without surcharge. My council used to charge 4% but dropped this charge 18 months ago so now I pay by cashback card!0
