Credit agreement Help

Hi Guys

This is my first post so please be gentle!

I have a few smallish debts that have been hanging over me for years since i turned 18 and discovered credit and store cards but never really got that i had to pay it back lol

I am sitting knee deep in debt letters trying to sort them out, i have tryed in the past but never quite managed to get very far, anyway my only question at the moment is about credit agreements.....

I have two debts with Aktiv Kapital both around £500 each and 6/7 years old (has been contact in this time so 6 year rule no good) i wrote about both last september requesting a copy of my credit agreement using the letter from National Debt Line? They sent me a copy for the first debt and i have been asking them to write off the debt and reconsider when they said no - this stands now at paying £1 per month

The other debt with them - they cannot find my credit agreement so i have been reminding them about the request every few months again using information from National Debt Line

I am writing again today and i basically want to say that they have had 12 months to send the information and as they should of done so within 12 weeks i want the debt written off immediatly - does anyone have any experience of them not being able to send the agreement and if i can threaten to report them to somebody if they dont cooperatate and continue sending me letters? any long words i can use?

  • If the amount or the debt is in dispute, and they are unable to provide a copy of the agreement then you should cease any further payments until they can prove the debt and correct amount to you.

    Theoretically you can report them to the OFT / trading standards, however in the real world this will have little effect. (but you should still do it anyway)

    Once you have ceased payments and they have been unable to proved details of the debt, you will then have to write to the Information Commissioners Office to request that they instruct the removal of any associated credit file data.

    N.B it is 12 Days to respond, not 12 weeks, and especialy not 12 months!
