Court action threat before br

Hi just after some advice please. My wife and I are going bankrupt on the 25th of August. We've been in an IVA for 12 mths but its not working for us at all. We put in PPI claims in with claim4refunds ( we didnt know we could do this ourselves) and they promised to get us our money back. We told them about the IVA and they said not a problem we'll still get our money. Unfortunatly it all went into the IVA when they verbally told us that we would get it, i.e the ppi companys would pay claim4refunds, and then they'd pay us minus their fee.We haven't seen a penny. Claim4refunds wanted £2500 off us, a week and many rude, disgusting and nasty phone calls later they changed their mind and said they wanted £4000. They have passed it to solicitors who say we have 7 days to pay or its going to court. What do we do? Tell them we're going BR or ignore it? Im worried that if we tell them we're going BR they'll speed the process up. My wife is suffering from bad depression and seeking medical help and I can't wait till the 25th to relieve her of the stress of it all. Thanks in advance, Geoff

    They cannot do anything via court as that you take waaaaaaaaaaaaaaay after the 2thh.

    Thanks, feel a little better now! Had more letters today and my wife has had lots of calls which she's ignored as theyre not nice people to deal with at all. I have heard the Daniels Silverman ( the debt recovery agents working on behalf of claim4refunds ) send collectors to you house without warrant though, which worries me as I'm working in the day and my 2 boys are at home with my wife. Any advice on what they should do if they get a knock at the door?

    Do not let them in, if they turn up and you know it is them I would just ignore them. They have no more powers than any doorstep caller. If they try and tell you otherwise they are lying. If they are threatening call the police and have them removed from your property. To be honest it is very rare that anyone will actually turn up but it does happen.

    I had to fill in acknowledgement forms as one of my creditors started proceedings. If they land before 25th just fill in that you wish to defend the claim, this buys you 28 days and you're home and dry.

    I then just put the court forms in with all the stuff i sent to receiver.
