My dad has another daughter and has been contacted today by the CSA because the mother has put in a new claim. She has called them to say that the daughter has gone back to college and she wants more money. Do the CSA have to prove that she's gone back to college? Because they weren't very helpful on the phone and treated my dad like crap!
My dad has paid maintenance in the past but stopped because the daughter had left education. Apparently she is now doing an EMA. Is this classed as education?
My parents need to know where they stand and what their rights are. They hardly have enough money to live on themselves and last time the CSA took so much money off my dad. They tried to appeal last time as they were told they could but the CSA just took it out of his wages. So much for a fair appeals process!!!
Any help would be appreciated. The mother is evil and has blackmailed my dad in the past. It wouldn't surprise me if she has made her daughter go back to college just so they can get some money!

she is not doing an ema thats for sure as ema is the education maintenence allowance awarded to those in full time education

She may be getting EMA - which as noted above, is an allowance that full time students doing certain courses qualify for - depending on household income threshholds.
It may seem unfair to you as your dad has had to struggle by throughout the years to support ALL of his children - including yourself. The fact is though, that as long as he has children who are in full time education, dependent on their PARENTS for support, then child support wil be payable. You were the lucky one who got to grow up in a household with both parents I assume. Just as your dad could not at any time through your dependent years, say 'sorry, I can't afford to feed you this month' to you, a parent cannot do this to a child they have who doesn't live with them. I know it's hard to see your father struggle, but if the shoe was on the other foot and your dad lived with the other child instead of you - I'm sure you would then agree that he had an obligation to help in providing for you. Your sister is entitled to the same opportunities as you are.0 -
Proberly best ignoring last post this is typical post from pwc, the truth is supporting your child isn't about giving to the pwc in can begone in many ways.
The truth is the csa and skmenowc don't give a poo how it will effect your dad finaicially or mentally actually they mayb be happy if it ruins him.
If he's unemployed they can't take much if he is self employed again they will struggle if he is employed well they will make an assesment and if he misses payments they will just take it out of is wage.0 -

This would be a change of circumstances and a new assessment would have to take place.

Has your dad put the complaint in to the CSA or asked for the assessments to be reviewed?

OP - there will be a new assessment by the CSA which will take into account your dad's current situation.
Yes, I am a PWC who has worked all my children's lives to do my part in providing for them - so yes, I also hold their father responsible for his part in doing the same. He was actually fortunate, as in Canada, he could easily have fought for custody of the boys had he wanted to - as fathers are just as likely to get custody there as a mother. He chose not to do that however - his choice. So yes - I'm guilty of being a PWC - and damned proud of it )0 -

Usually rubbish love, I never said I was the best at either spelling writing or typing but it's obvious from the utter garbage that comes from your mouth what type of person you are, let's hope your children never have difficults it that department has they will be left with scares.
The girl come on her for advise about real concerns in the real world were the csa punish the fathers who stand up to be counted but you come on trying to make her feel bad

Well how old is the other daughter? CS is only payable up to 19, so even if he is assessed now surely he's on the home straight as there can't be much longer for him to be liable anyway.
The daughter may genuinely have gone back to college, if not, then it may be worth following this up and demanding an enrollment and attendance documentation as evidence,0
