Good Morning

I need some advice, i had a loand with Cahoot for £9,000 over 6 years ago which i was paying, i unfortunatley had a reduced earning income after a few years and phone cahoot who agreed to a reduced debt management payment over 10 years for the remainder of the loan at £42 per month

i have been paying this for over 4 years now and the balance is now £3197, cahoot was bought by banco santander and then i recieved letter from BCO Santader saying i was in arrears and was passing this onto debt management even though i had an agreement with cahoot and in writing as well.

now apex are chasing me every day, atleast 7 times a day saying i have to call them, i did phone and the lady i spoke to said can i pay the debt off now or make three payment which i said no to.

i expalined the above to her and asked if they have the original credit agreement and she replied no just that we have taken on the debt and it needs to be paid now, i said i can not do this but am happy to pay monthly like i was, i asked her to send a monthly budget planner and she replied we do not do that, its only over the phone i said i would not do that today.

also my dd is still set up with cahoot and a payment was taken on the 2nd aug for £42, when i brought this up she said she had not seen that payment and i would need to phone cahoot to get this back as its just disappeared, please can you advice me on what i need to do

    Have Apex actually written to you yet? Best thing is not to talk to them or enter discussions on the phone. If you have a letter from then write to them with the prove it letter -http://forums.moneysavingexpert.com/showpost.html?p=11570893&postcount=2 .
    If no letter from them yet next time they call tell them to write to you and hang up.

    If they respond to that and show proof of the debt and proof they should be collecting it then you could ask for the CCA if you wanted or you could write to offer to continue the payments at the level they are now.

  • hi yes had a letter, however just a letter saying call them and what is owed, so should i write a letter back asking them for what exactly, proof of buying the debt or the original credit agreement etc
